Terms of Business

We keep legal matters and small print to a minimum but need to be clear about what you can expect from us and what we expect from you.

These terms of business which are governed by the laws of England and Wales and may need to be amended from time to time.

Business between us is subject to the terms and conditions in force at the time of placing your order.

“We” means MS Associates Limited, whose registered office is at Aylmer Parade, London, N2 0AT. MS Associates Limited is a Company registered in England and Wales no. 196824. Our trading name is Mr Smith World Photography.

“You” means you, the customer.

“Products” means artwork, image files and any associated services we may provide.

The products we supply are as described on our website, and in emails, computer files or letters exchanged between us. Although we do all we can to ensure products are accurately described please be aware that appearance of items may vary slightly from the way they appear on different computer screens or on different media. All of our products are manufactured to order according to a specification we agree with you.

The images and designs used on our website are our property and we are the copyright owner. You must not reproduce, modify or distribute our images or any part of those images in any manner.

When you order our products you are entering into a contract with us. Placing an order is an offer to buy. We accept your offer when we send you an invoice. On the very rare occasions we cannot accept your offer we will explain why and refund any amounts you have paid in full. The price of our products and delivery charges will be quoted to you at the time of order. We take payment with order either by credit card or bank transfer. Ownership of Products will pass to you when we have received full payment.

All of our products are delivered by courier or by post to the delivery address provided when you place your order. Once your order is confirmed, we will endeavour to deliver the goods within the delivery period that applies to the option you have chosen. The Delivery Date is approximate only and the time of delivery shall not be of the essence unless agreed by us in writing.

If products are not received when they are expected we will help to to determine why. If the postal services deem them to be lost we will arrange for replacements to be sent out to you.

Goods delivered outside the UK may be subject to import duty or delays at customs. As we have no control over this, any additional charges and arrangements that need to be made with customs are your responsibility.

If there are any problems with your order please let us know as soon as possible and we will try our best to resolve them to your satisfaction.

Please advise us if goods are not received on the agreed date. Claims for non delivery must be made within 28 days of dispatch. If goods are faulty or damaged we will replace them. We will ask you to return them to us and tell you how to do it. Returns will only be accepted for this reason and need to be agreed in advance. We will refund any money due to you, by the same method used to pay us, as soon as goods have been received by us. We do not carry any stocks of artwork and everything is made to order. Because of this once your order has been placed it cannot be cancelled.

Whilst we aim to give you a great customer experience sometimes things go wrong. We will not be liable or responsible for any delays or problems caused by events outside our reasonable control. In any event our liability will be limited to the amount you have paid us for our products.

If you are a business customer, we may wish to disclose that we have supplied you with prints or images and to use your name in marketing materials. If we do this we will identify you by name but we will disclose only the general nature of our business relationship. We will not disclose any other details about you without obtaining your prior consent. By accepting these terms confirm that you consent to this disclosure. Your consent can be withdrawn at any time in writing.
